TERMS AND CONDITIONS OF USE

GENERAL TERMS AND CONDITIONS OF RAMCO (UK) LIMITED

Caution: In their own interests, prospective purchasers should read this before inspecting/purchasing

Many of the goods for sale are described by make, type, size output etc. It should not be taken for granted that they are in original manufactured condition, complete with all component parts and in good working order. Nor should it be taken for granted, that the goods can be put into working order. Many of the goods declared surplus to Government requirement on account of age, fair wear and tear, obsolescence, etc. or because it would be uneconomical to repair them to bring them up to the high standards of efficiency required by the Government. Goods which appear to be in original wrappings and unused may have incurred many years of shelf life.

In view of their age or condition some of the goods may not comply with current safety legislation as required under the Health and Safety at Work etc Act 1974 and supporting regulations. Prospective purchasers are reminded that it would be an offence under the Consumer Protection Act 1987 to sell or supply goods which do not comply with currents regulations made under Acts. Prospective purchasers are also reminded that sales by tender are not consumer sales for the purposes of the Unfair Contract Terms Act 1977.

PLEASE NOTE: NOT ALL PROPERTY IS GOVERNMENT OWNED AND RAMCO RETAIN THE RIGHT TO WITHDRAW ANY ITEM. IF IN DOUBT ALL PURCHASERS SHOULD THOROUGHLY INSPECT THE GOODS IN WHICH THEY ARE INTERESTED IN BEFORE PURCHASING.

1. Prices

All prices bid shall exclude VAT. VAT at the rate prevailing shall be charged on all goods sold and a tax invoice will be issued for the VAT charged.

2. Acceptance

Your purchase shall be acceptance of these terms. No other purported terms of purchase shall apply.

3. Inspection

Should goods be purchased without previous inspection the purchaser shall do so at his own risk.

4. Condition and Quantity of Goods

The goods are sold as they lie, and shall be taken with all faults and with all errors or misstatements of descriptions, measurement, weight, quantity, number or otherwise (whether of a substantial nature or not) and the Purchaser shall have no claim against RAMCO (UK) LTD in respect of any such faults, errors or misstatements. No warranty, express or implied, is given as to conditions, or suitability for purpose, and the purchaser should satisfy himself that the goods are fit for use in the intended manner.

5. Payment

Payment for all goods shall be made within the time for payment specified in the contract and title to the goods shall not pass to the Purchaser until the purchase price has been paid in full. The goods shall be at the Purchaser’s risk upon notification by RAMCO (UK) LTD of acceptance of the bid to purchase.

6. Removal

Unless otherwise agree, the goods shall be removed by and at the expense of the Purchaser and such removal shall be completed within 14 days from the date of purchase (unless a specific timescale has been specificed in the contract) the More details can be found here.

7. Failure to remove goods

If the purchaser, having paid the full amount of the purchaser price, fails to remove all the goods within 14 days from the date of purchase ( unless otherwise prescribed by the contract). RAMCO (UK) LTD shall be entitled at any time to exercise either or both of the following powers as and when RAMCO (UK) LTD may see fit, that is to say: –

 

a) without notice to the Purchaser, to put all or any of the unremoved goods into any place or places (whether indoors or out of doors) which RAMCO (UK) LTD may decide and where they will lie at the risk of the purchaser, and

b) by notice in writing to the Purchaser, after a calendar period of 30 days, to dispose of unremoved goods for financial return or as waste. There shall be payable by the Purchaser to RAMCO (UK) LTD the full amount of any costs incurred and losses suffered by RAMCO (UK) LTD in the course of or as a result of exercising either or both of the foregoing powers.

8. Limitation of Ramco (UK)’s liability

Ramco (UK) Ltd. shall not be liable in respect of any claim (other than claims arising out of the negligence of Ramco (UK) LTD) by the purchaser arising out of, or in any way in connection with the sale of all or any of the goods under the Contract for any sum exceeding the amount of the deposit or purchase price (as the case may be) paid by the Purchaser in respect of the goods which are the subject of the claim.

9. Proper Law

Any contract for sale directly from Ramco (UK) Ltd. submitted under these terms shall be subject to the laws of England.

10. Pallets & Stillages

Pallets, stillages or similar storage media are not included in any sale.
